Health Guarantee

We have done all that is possible to ensure that your new puppy is in good health. We want you to know that our relationship with you does not end when you take your puppy home. We are available to answer any questions you have to the best of our knowledge. The animal’s health is guaranteed by the seller to be free from any inherited disease which impairs a long life, such applies for up to one year of life. If such an inherited defect should occur, be verified in writing by a qualified veterinary specialist, the seller agrees to replace the animal upon return of the animal to the seller.

As a conscientious breeder, we’d like you to believe that nothing can or will ever go wrong with any of our puppies. However, to be realistic, we know that some things are not in our control. It is very important to your new puppy’s health that you continue to provide all the necessary vaccinations, a healthy diet with quality dog food, regular veterinarian care, adequate living conditions, and lots of love. To start off right, it is necessary that you take your puppy to a licensed veterinarian within 3 business days of receiving your puppy (excluding weekends), so you and I can both be sure that your puppy arrived happy and healthy. Please start a folder of your puppy’s medical records and be sure to keep a copy of all vet checks. Failure to provide your puppy with timely inoculations or regular vet care will void this guarantee. Please take the health record that we send with your puppy to his/her veterinarian, so they can see what vaccinations and deworming that has already been given and will not re-do them unnecessarily. 

  • Health Check Policy - Before your puppy is sent home to you, he or she has undergone an extensive veterinary health check and all vaccination and deworming protocols have been followed to ensure 
    your puppy arrives healthy and happy.

  • No warranties or guarantees, expressed or implied, are made under this contract except as stated. 

  • This warranty is non-transferable. 

 


BUYER’S RESPONSIBILITIES

The buyer must fulfill these obligations, as explained herein, or this Health Guarantee will terminate and become null and void.

 

  • The Buyer agrees to have the puppy examined by a licensed veterinarian within three (3) business days of taking possession. 

 

  1. If the puppy is found to be in poor health, the Buyer has the option of returning the puppy to the Seller, at the Buyer’s cost, for a full refund. 

  2. The Buyer will provide a written statement from a licensed veterinarian clearly stating the defect or illness.

  3. If the puppy is not taken to a licensed veterinarian within three (3) business days of taking possession, the health warranty is void. 

  4. Please ensure that the puppy is kept in a kennel or held in the waiting room of a veterinary office and that the exam room is properly disinfected before the appointment. 

  5. Do not let the puppy walk on the floor in the veterinary office and ensure the room was cleaned prior to putting your puppy on the table. Seller recommends bringing a clean towel or blanket with you to be safe.

 

  • Your puppy comes with up to date vaccinations. You therefore should not vaccinate the puppy within the first ten (10) days of receiving the puppy to avoid over-vaccination. 

 

  • The Buyer is responsible for all medical expenses associated with the treatment of intestinal parasites if the puppy is diagnosed, even if the puppy has parasites present when sent home). If you are not willing to treat puppy parasites (sometimes more than one treatment is needed), then please do not buy a puppy. It is common for puppy parasites to flourish after joining their new family (stress and change accommodate this). Most parasites can be contagious, and it is possible that other dogs in the house can get them. Do not let your other dogs eat the puppy’s feces and clean it up immediately using proper cleaning chemicals. 

 

  • Do not over-exercise your dog during his or her growth period to minimize joint damage as puppies develop.

 

  • These dogs are intended to be companion dogs; do not breed your dog. The dog must be spayed and neutered within 1 year of sale. If your dog is bred or the seller did not receive written evidence from DVM of spay/neuter this Health Guarantee shall terminate and become null and void.  

 

TERMS AND CONDITION OF HEALTH GUARANTEE

 

These terms and conditions only apply to puppies bred by Poodlely, Longwood, FL USA.

 

  • The puppy is guaranteed to the original buyer for (1) one year against debilitating congenital defects.  If within one (1) year from the date of purchase from Seller, a dog is found and certified by two (2) duly licensed Doctor of Veterinary Medicine (DVMs) of Purchaser's choosing to have a life threatening congenital defect  and if Seller is notified within five (5) business days of the first veterinarian's determination, the Seller will provide a replacement puppy of equivalent value. Seller reserves the right to obtain a third opinion of Seller's choosing to determine the life threatening congenital or hereditary condition. All laboratory verification must be done by a licensed DVM.  OFA shall be the sole judge regarding any orthopedic diagnosis.  

 

  1. Breeder determines which puppy (of equal or lesser value) will be used as a replacement and the wait may be as long as 6-12 months.

  2. Color or gender is not guaranteed.

  3. Shipping fees will not be refunded, and any costs associated with the shipping 

 

 

  • Veterinary Costs: It is to be clearly understood, that the Seller does NOT, under any circumstances, accept responsibility for any veterinarian and/or health care expense. 

 

  • Purchaser Acknowledgments: Purchaser is aware that owning a puppy means frequent visits to a licensed DVM (at least once a year) and understands that he/she will be responsible for all costs associated with all veterinarian visits, such as but not limited to any veterinarian costs associated with spaying or neutering, including undescended testes. Failure of the Purchaser to provide the puppy with timely inoculations or regular (at least once a year) veterinary care will void this Health Guarantee. Purchasers should follow a recommended nutritional program, including feeding only premium dog foods and vitamin supplements such as NuVet. The dog should not be over-exercised during its growth period. 

 

 

  • The seller sells pets for companion purposes only. The dog must be spayed and neutered within 1 year of sale.  If credible written proof is not given within one year to the seller of the spay or neuter the seller is entitled to $10,000 in damages. If your dog is bred, this Health Guarantee shall terminate and become null and void. Temperament issues are not covered under this Health Guarantee as they can be caused by a number of factors outside the control of Seller including, without limitation, lack of training, discipline, or proper dog socialization. 

 

  • The owner is responsible for all transportation costs to and from the Seller.

 

 

  • In addition to all the conditions set forth in this agreement, the following additional conditions shall apply and must be met, or this Health Guarantee shall terminate and become null and void:

 

  1. The Purchaser must sign a Veterinarian Medical Records Release Form and have the puppy examined by a licensed DVM within three (3) business days of receipt of the puppy, for the puppy's New Puppy Examination (NPE). A copy of the examination (a medical record) for the NPE must be sent to Poodlely by e-mail (poodlelypuppies@gmail.com).  The Purchaser shall not vaccinate the puppy within the first ten (10) days of receiving the puppy. Failure of the Purchaser to comply with the provisions of this subpart (i) shall void this Health Guarantee.

a)    If the Purchaser declines any replacement puppy, then the Seller shall be under no further obligation and it shall be deemed that the Purchaser has released the Seller from any and all further claims and waived any rights to pursue any claims against the Seller.

b)     This Health Guarantee shall terminate and become null and void if the Purchaser fails to comply with any term in this Agreement regarding the care, maintenance, or medical treatments or procedures that the Purchaser is responsible for providing to the puppy. This Health Guarantee shall also terminate and become null and void if the Purchaser fails to comply with any term in the Puppy Purchase Contract.

 

The value of the puppy for purposes of this Health Guarantee is limited to the Purchase Price of the puppy and does not include taxes, shipping, health certificate, and veterinarian costs, shipping crate, or any additional costs or expenses incurred or asserted by the Purchaser. This Health Guarantee is non-transferable and is not valid for sales of any puppies delivered outside the United States and Canada.
